Den richtigen Immobilienmakler finden . Mit einem Rundschreiben hat das Bundesfinanzministerium auf das Thema verkürzte Restnutzungsdauer reagiert. Durch ein Urteil des Bundesfinanzhofes vom 28.07.2021 war es für Vermieter deutlich einfacher geworden, ein kürzere Restnutzungsdauer für Ihre Immobilie nachzuweisen und somit in den Genuss einer höheren Abschreibung zu kommen. Bereits mit dem Jahressteuergesetz 2022 hatte der Finanzausschuss einen Vorstoß gewagt und wollte die Regelung des § 7 Absatz 4 Satz 2 Einkommensteuergesetz vollständig abschaffen. Dies wurde dann aber in letzter Minute bei der Abstimmung aus dem Entwurf gestrichen, so dass die Regelung grundsätzlich auch künftig weiter gilt. Es war aber zu erwarten, dass die Finanzverwaltung auf diese sehr vermieterfreundliche Rechtsprechung des BFH reagieren würde und genau das geschah nun mit dem vorliegenden Rundschreiben. Im Ergebnis verneint das Bundefinanzministerium die Anwendung des Rechenmodells zur Berechnung der Restnutzungsdauer, wie es in der ImmoWertV (Immobilienwertermittlungsverordnung) normiert ist für die Zwecke der Abschreibung.
